The office of the Register of Deeds is an elected office. The
term of office is four years and the next county election is
in 2011. A fine attention to detail and accuracy is helpful
in understanding complex legal descriptions and the multi-faceted
documents encountered every day.
The land records date to the beginning of Cass County in 1855.
All deeds for land transfers since that date can be searched
by legal description or by name. The records in this office
are open to the public and copies of accessible recorded instruments
can be obtained for a small fee.
The Register of Deeds is responsible for maintaining accurate
and current land records. Numerous documents relating to real
estate including deeds, mortgages, easements, contracts, assignments,
releases and plats are recorded in this office. Federal and
State Tax Liens and UCC Financing Statements are also found
in the office records.
Recording fees are set by Nebraska Statutes and are standard
throughout the state. The fee for recording documents is $5.00
per page and $ .50 per lot or section. A blank space at least
2 1/2" deep by 6 1/2" long at the top of the first
page is required for recording information. The Register of
Deeds may add a cover page if this space is not provided and
charge an additional $5.00. All documents presented for recording
must include a complete legal description and a book and page
reference if applicable.
UCC Financing Statements and Federal and State Tax liens fees
fall under different recording guidelines.

County cadastral maps are kept current showing all subdivisions
and landowners. Each of the 20,000 plus parcels in the county
is shown on these maps. Aerial views of rural land have been
available for years and work is in progress for aerial views
of county towns.
Approximately 8,000 documents are recorded each year. A software
program, begun in March 2001, stores all data. All records are
also entered into numerical indexes, copied, and microfilmed
annually. This office handles approximately $250,000 in fees
and Documentary Stamp Tax annually. Cass County retains all
fees and .2858% of the Documentary Stamp Tax collected. The
remaining Stamp Tax is remitted to the Nebraska Department of
Revenue.
